 Japanese Course - L&P

Please read these Terms and Conditions (“Terms”) carefully before purchasing or accessing Japanese Course - L&P (the “Course”). By purchasing, accessing, or using the Course, you agree to be bound by these Terms. If you do not agree, do not purchase or access the Course.

 

1. About the Course

Japanese Course - L&P is a digital educational product offering instructional content related to learning the Japanese language. The Course is delivered online through the Kajabi platform and may include video lessons, written materials, audio files, downloadable resources, and other educational content.

The Course is provided by Sheriff Tchio (“we,” “us,” “our,” or the “Instructor”). For any questions related to these Terms or the Course, you may contact us at [email protected].

2. Eligibility and Account

To purchase and access the Course, you must be at least 18 years old, or have the consent of a parent or legal guardian. You are responsible for maintaining the confidentiality of your Kajabi account credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information at the time of purchase. We reserve the right to suspend or terminate accounts that contain false information or that are used in violation of these Terms.

3. Purchase, Payment, and Access

By completing your purchase, you authorize us (through Kajabi and its payment processors) to charge the full amount listed at checkout. Prices are listed in the currency displayed at checkout and may change at any time, but changes will not affect purchases already completed.

Upon successful payment, you will receive access to the Course materials through your Kajabi account. Access is granted for the duration specified on the sales page at the time of purchase. If no duration is specified, access is granted for as long as the Course remains available on our platform, subject to these Terms.

4. No Refund Policy

All sales are final. Due to the immediate digital nature of the Course and the fact that materials become accessible upon purchase, we do not offer refunds, returns, exchanges, or cancellations for any reason, including but not limited to:

  • Change of mind
  • Failure to use, complete, or access the Course
  • Dissatisfaction with the content, pace, or teaching style
  • Technical issues on your end (internet, device, browser, etc.)
  • Misunderstanding of what the Course covers

By purchasing the Course, you expressly acknowledge and agree that you waive any right to a refund and that you have reviewed the Course description before purchasing.

If you experience a genuine technical issue preventing access to the Course on our side, please contact us at [email protected] and we will make reasonable efforts to restore access.

5. License and Permitted Use

Upon purchase, you are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Course materials for your own personal, non-commercial educational use only.

You may not:

  • Share, sell, gift, lend, rent, sublicense, or otherwise transfer your account credentials or Course access to any other person
  • Copy, reproduce, download (except where a download function is explicitly provided), distribute, publish, broadcast, or publicly display any part of the Course
  • Use any part of the Course to create derivative works, competing products, or other educational materials
  • Record (by screen capture, camera, or any other means) the Course videos or live sessions
  • Use the Course content to train any artificial intelligence, machine learning model, or similar system
  • Translate, modify, reverse engineer, or attempt to extract source materials from the Course
  • Use the Course in any way that violates applicable law

Violation of this section will result in immediate termination of your access without refund, and we reserve the right to pursue legal remedies.

6. Intellectual Property

All Course content — including but not limited to videos, written lessons, audio recordings, slides, worksheets, graphics, logos, branding, methodology, structure, and the “Japanese Course - L&P” name — is the exclusive intellectual property of Sheriff Tchio and is protected by copyright, trademark, and other applicable intellectual property laws.

Nothing in these Terms transfers any ownership rights to you. All rights not expressly granted are reserved.

7. User Conduct

If the Course includes any community features, comment sections, live sessions, or other interactive elements, you agree to:

  • Treat the Instructor and other students with respect
  • Refrain from posting harassing, hateful, discriminatory, defamatory, or sexually explicit content
  • Refrain from spamming, advertising, or promoting unrelated products or services
  • Refrain from sharing Course materials with non-members

We reserve the right to remove any content and to suspend or terminate access (without refund) for any user who violates these conduct rules, at our sole discretion.

8. Educational Disclaimer and No Guarantee of Results

The Course is provided for educational and informational purposes only. It is a self-study learning resource, not a tutoring service, certification program, or guarantee of language acquisition.

8.1 Marketing Claims Are Illustrative

Our marketing materials, including but not limited to the headline “Learn and speak basic Japanese in 30–60 days” and any similar statements regarding timeframes, outcomes, fluency levels, conversational ability, reading ability, vocabulary acquisition, or progress, are illustrative, aspirational, and based on the experience of motivated learners who follow the Course as designed. They are NOT a promise, guarantee, warranty, or contractual commitment of any specific result for you personally.

The word “basic” refers to introductory-level Japanese as defined by the Instructor’s curriculum, not to any external benchmark (such as JLPT levels, CEFR levels, or any government, academic, or third-party language standard).

8.2 No Guarantee of Results

We make no guarantees, warranties, or promises — express or implied — regarding:

  • Whether you will be able to speak, read, write, or understand Japanese at any level
  • How long it will take you to reach any particular level
  • Your performance on any test, exam, certification, interview, or real-world conversation
  • Your ability to communicate with native speakers
  • Any career, academic, travel, personal, or financial outcome resulting from your use of the Course

8.3 Results Depend on You

Language learning outcomes depend on many factors entirely outside our control, including but not limited to: your time investment, consistency, prior language-learning experience, motivation, learning style, native language, cognitive factors, age, environment, access to practice partners, and willingness to apply the methodology taught. You alone are responsible for your results.

8.4 Testimonials

Any testimonials, case studies, screenshots, or success stories shared by us reflect the experiences of specific individuals and are not typical, not guaranteed, and not representative of what you should expect. We do not pay for testimonials, but featured students may have received the Course at a discount or for free in exchange for feedback.

9. Course Modifications and Availability

We reserve the right to:

  • Update, modify, add to, or remove portions of the Course at any time
  • Change the platform on which the Course is hosted
  • Discontinue the Course at any time

Where reasonably possible, we will provide notice of significant changes. We are not liable for any losses arising from such modifications, and discontinuation of the Course does not entitle you to a refund.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Course is provided “as is” and “as available,” without any warranties of any kind, whether express or implied (including warranties of merchantability, fitness for a particular purpose, or non-infringement).
  • We shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Course.
  • Our total aggregate liability to you for any claim arising out of or related to these Terms or the Course is limited to the amount you actually paid for the Course.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you to the extent prohibited by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Sheriff Tchio and any affiliates, contractors, or assistants from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Course; (b) your breach of these Terms; or (c) your violation of any rights of a third party.

12. Third-Party Platforms

The Course is hosted on Kajabi and may rely on third-party services (payment processors, video hosting, email providers, etc.). Your use of those services is subject to their own terms and privacy policies. We are not responsible for the actions, downtime, or policies of any third-party platform.

13. Privacy

Your purchase and use of the Course involves the collection of personal data (such as your name, email, payment information, and usage data). This data is processed in accordance with our Privacy Policy and the privacy practices of Kajabi and its sub-processors.

14. Termination

We reserve the right to suspend or terminate your access to the Course at any time, without notice and without refund, if we believe in good faith that you have violated these Terms, infringed our intellectual property, abused other users, or otherwise acted in a way that is harmful to the Course, the Instructor, or other students.

Upon termination, the license granted in Section 5 immediately ends.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to its conflict of laws principles. You agree that any dispute arising out of or related to these Terms or the Course shall be brought exclusively in the courts located in Montréal, Quebec, and you consent to the personal jurisdiction of those courts.

Where mandatory consumer protection laws in your country of residence grant you additional rights, those rights are not waived by this section.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with any sales page, order confirmation, and our Privacy Policy, constitute the entire agreement between you and us regarding the Course and supersede any prior agreements.

18. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with a new “Last updated” date. Continued use of the Course after changes constitutes acceptance of the revised Terms.

By purchasing Japanese Course - L&P, you confirm that you have read, understood, and agreed to these Terms and Conditions. In particular, you acknowledge and agree that:

  • You have read and accepted the No Refund Policy in Section 4;
  • You understand that the “Learn and speak basic Japanese in 30–60 days” headline and any similar statements are illustrative marketing claims, not guarantees, and that your results depend on your own effort and circumstances (Section 8); and
  • You have reviewed the Course description before purchasing and are satisfied that the Course meets your needs.
